As I understand it that's the law in WA and OR. We have a release form for
our club field trips and if we're collecting with permission we get a rider
for the landowner on our liability insurance. One landowner had a terrible
accident after we stopped doing trips to his ranch and he didn't bother with
insurance or release forms. The lady collapsed a wall in his thunderegg mine
onto herself and was trapped by her legs. She had to be life-flighted out
and had some major surgery done. Thankfully she didn't sue him or I think it
would have bankrupted him. I can email the release form if that helps. It's
essentially the CalFed form, available here

Kind list members,
I am seeking assistance in locating the specifics for a law I "THINK" I had
read about, but, considering the effort I have put into it, it may have
simply been a wishful manifestation. I believe the law to be of either
Michigan or Wisconsin legislation, whereby, if a person, individually, or as
part of group, obtains permission to access property ( in this case to
collect rocks ) they relinquish any right to sue or hold liable the property
owner, in exchange for the privilege of their activity. However, if you are
trespassing, the individual or group can be held liable to the highest
account, of any infraction incurred to the property owner.
Any assistance in identifying such legislation would be greatly
appreciated!!!!
